You automatically agree to the following terms of use when you purchase and download Photo Finish photo templates from Happy to Create, LLC.
Happy To Create designers retain their copyright to the art in the digital downloads. All rights are reserved and duplication is strictly prohibited. Do not share the products/files with others. All downloads and purchases are tracked via IP address.
By downloading Happy To Create, LLC graphics, templates, e-books, images, videos, crafts, and fonts, including free samples, you agree that all digital downloads are copyrighted by the individual artist and licensed to you as a single user. You do not own the products; you are purchasing the following license to use the products.
- You are purchasing a license to use the Photo Finish photo templates in the manner detailed below:
- All Photo Finish photo template products are available for personal and limited commercial usage. Limited commercial use is restricted to professional photographers to use the templates to create products for their clients and collateral for their business, using professional photographs they have created.
- You (Licensee) may not alter the templates (or any of the digital elements) and resell the files as your own designs.
- You (Licensee) may not use the elements (graphics, embellishments, drawings, patterns, textures, or art) in any other form, you may not remove them from the template, sell them nor claim them as your own work.
- You (Licensee) may not advertise the templates for sale to the general public. (i.e. Ebay auctions or Etsy stores.)
- You (Licensee) may not offer the templates as part of a business (either online or brick and mortar) where a client submits a personal photograph and you deliver a printed product.
Due to the digital nature of these products offered, no refunds will be given.
Commercial Use Product Copyright Statement
Licensee (the commercial customer/the individual who purchased the product) hereby acknowledges that Licensee is licensing the graphic images/software for commercial use as described below.
Licensee hereby agrees to pay liquidated damages to Licensor (copyright holder) in the amount of $5,000.00 for any non-allowed commercial use. In addition, should Licensor incur any attorney fees or other costs in collecting and/or enforcing this liquidated damages provision, Licensee agrees to reimburse Licensor for all such fees and/or costs. The parties acknowledge that the liquidated damages set forth above are reasonable in amount, that actual damages would be extremely difficult or impractical to determine and that any dispute or potential dispute over actual damages would be disruptive to the businesses of the parties so that it is in both parties’ best interest to have determined the amount of such reasonable liquidated damages.
The files contained in this e-file are the product of and the copyright is held by a Happy To Create, LLC Designer or Artist (refer to download materials for specifics) and are being distributed by Happy To Create, LLC. The Licensee may use, copy and modify these files for their own small business use according to these terms: Licensee may alter colors, change type/fonts, insert their photographs on Photo Finish photo templates. Licensee will personally sell or profit via sales to individuals using the licensed materials.
Licensee may not turn the designs over to any company permanently for any reason.
Licensee may not use the files for design work that will be turned over to another company or individual with the intention that the other company or individual will resell or license the derivative work.
Licensee may not sell, loan, rent, or distribute the designs via any method to any individual or company in their original state.
Commercially licensed products are to be considered a design tool rather than a final design product; are licensed to the purchaser’s computer only; and are not to be shared, loaned, rented, resold, distributed, transferred, or posted across a bulletin board, network, modem, Internet or web page.
If you use this or any Happy To Create, LLC product(s) in an unauthorized manner (such as unauthorized sharing with individuals or groups), you will be liable for liquidated damages of $5,000 and all attorneys’ costs and fees as described above.
